General Terms and Conditions (Terms of Use)
§ 1 Operator and scope
voziti.eu is operated by SaltySoulCreatives (hereinafter the “Operator”). Further details can be found in the legal notice.
These terms apply to the use of the website voziti.eu in all language versions and of all related features and interfaces by visitors and registered users – private individuals (consumers) and commercial sellers (dealers). Users’ own terms do not apply unless the Operator expressly agrees to them in text form.
§ 2 Services of the Operator
voziti.eu is an online marketplace on which users can publish and search listings for vehicles, vehicle parts and vehicle-related offers and contact each other. The Operator only provides the technical platform. Contracts of sale, exchange, rental or other contracts concerning the vehicles and goods offered are concluded exclusively between the users concerned; the Operator is neither a party to, nor a representative, broker or agent of, such contracts and does not handle their performance (e.g. payment, handover, warranty).
Features include, among others: publishing and managing listings (individually, by bulk upload or via connected dealer software), photo upload including via smartphone, search with filters and suggestions of similar vehicles, a watch list, messages between users, dealer profiles, as well as automatic translation of listing texts and assistance with writing descriptions. There is no entitlement to particular features or to uninterrupted availability; the Operator may develop the platform further and change features insofar as this is reasonable for users.
§ 3 Registration and user account
- A user account is required to publish listings and send messages. Only persons of full age with full legal capacity, and companies represented by an authorised person, may register.
- The information provided during registration and in the profile must be true, complete and up to date. Each user may hold only one account unless the Operator permits otherwise.
- Dealers (commercial sellers) must register as such, provide truthful company details and have their listings marked as commercial. Anyone acting commercially may not present themselves as a private seller.
- Login details must be kept secret. The user is responsible for all activities under their account to the extent they are at fault and shall inform the Operator without delay if misuse is suspected.
§ 4 Listings and content
- Listings must describe a specific offer that is actually available and that the user offers or is authorised to act for. Details of the vehicle, condition, mileage, defects, price and location must be true and complete; known defects and accident damage must be disclosed.
- In particular, the following are not permitted: unlawful, misleading, discriminatory, offensive content or content harmful to minors; stolen goods or goods not legally marketable without a corresponding note; content infringing third-party rights (e.g. other people’s photos or texts without permission); pure advertising, chain letters, bait offers and duplicates; links or requests for contact intended to lead users into fraud or to other platforms.
- By publishing, the user grants the Operator the non-exclusive, free right, limited to the duration of the listing (plus usual technical deletion periods), to publish the content on voziti.eu and its language versions, to process it technically (e.g. image size, watermark), to translate it automatically, to display it in search results and on category and brand pages, and to make it available to search engines and to previews on social networks.
- Automatic translations and writing assistance are generated using artificial intelligence and may contain errors. The original text entered by the user is authoritative; users check any suggested wording they adopt on their own responsibility.
- A listing normally runs for 90 days. After that it is deactivated and can be reactivated by the user (subject to a fee under § 5 where applicable). If it is not reactivated, it is permanently deleted together with its photos six months after expiry; the user receives an email reminder beforehand. Users remove or deactivate listings without delay as soon as the offer is no longer available.
- Dealers can transfer listings by spreadsheet upload or via connected dealer software (e.g. SALTYDATA). They are responsible for the transferred content in the same way as for manually published listings.
§ 5 Prices, payment and paid services
- Using the search and contacting sellers is free of charge. Fees may apply for publishing listings; additional services such as “Top offer” and dealer flat rates are also offered. The prices and service descriptions stated on the Prices page at the time of booking apply.
- Publishing listings is free of charge up to and including 31 December 2026. Listings in the categories spare parts, community and certain boat categories (accessories, canoes & rowing boats, boat engines) remain permanently free. The Operator will give timely notice of price changes; services already paid for are not affected.
- Payment is made in advance via the payment service provider Stripe using the payment methods offered there. The service is activated after successful payment. There is no refund for services already provided if a listing is deleted early by the user or removed because of a breach of these terms; statutory rights remain unaffected.
- Flat rates include a quota of vehicle listings and, during their term, replace the individual listing fees for dealers. Even with a flat rate, each listing runs for a maximum of 90 days. Scope, term and renewal are as stated in the booking.
§ 6 Right of withdrawal for consumers
Consumers have a statutory right of withdrawal for paid services. You may withdraw from your contract within 14 days without giving any reason. The period begins on the day the contract is concluded. To exercise it, a clear statement (e.g. via the contact page; contact details in the legal notice) addressed to SaltySoulCreatives is sufficient; you may use the model form below, but this is not obligatory. Sending the withdrawal before the period expires is sufficient.
Effects of withdrawal: We will reimburse all payments without undue delay and no later than 14 days after receiving the withdrawal, using the same means of payment. If you requested that the service begin during the withdrawal period, you pay a reasonable amount for the part provided up to the withdrawal.
Early expiry: For service contracts, the right of withdrawal expires when the Operator has fully performed the service (e.g. activated the listing or the Top offer) and you expressly agreed before booking that performance may begin before the end of the withdrawal period and confirmed your knowledge that you lose your right of withdrawal once the contract has been fully performed.
Model withdrawal form: To SaltySoulCreatives (address and email see legal notice) – I/We hereby give notice that I/we withdraw from my/our contract for the provision of the following service: … / ordered on: … / name: … / address: … / date, signature (only if notified on paper).
§ 7 Display, ranking and advertising
- Search results are displayed according to the sort order chosen by the visitor (default: newest first; alternatively price or year of manufacture). Listings booked as a “Top offer” are shown – marked as such – ahead of the other results. Beyond this, the Operator does not influence the order in return for payment.
- If the search finds no or only a few exactly matching listings, “similar results” are shown separately below with the reason stated (e.g. similar version, same make, same vehicle type). The budget specified by the visitor is not exceeded.
- Listings are marked as “private” or “commercial/dealer” according to the seller’s declaration. Consumer protection rights (e.g. statutory warranty) generally exist only towards commercial sellers.
- Advertising banners and partner links (e.g. to online tyre retailers) appear on voziti.eu. They are marked as “Sponsored”. If a visitor buys via a partner link, the Operator may receive a commission; this does not cause any extra cost for the visitor.
§ 8 Obligations and prohibited use
- When using the platform and doing business with each other, users comply with applicable law, in particular consumer protection, tax, trade and vehicle registration law.
- Automated extraction of content (scraping), circumventing technical protection measures, sending spam or mass messages, using other users’ contact details for purposes other than handling the specific offer, and any form of fraud or harassment are prohibited.
- The Operator recommends not making advance payments to strangers, inspecting vehicles before buying and checking vehicle documents.
§ 9 Reporting illegal content, moderation and point of contact
- Anyone can report content they consider illegal or in breach of these terms via the contact page – ideally with the link or listing number, a reason, and their name and email address. The Operator reviews reports promptly, diligently and objectively and informs the reporting person of the outcome.
- The Operator may review listings before or after publication and reject, block or remove content that breaches the law or these terms, and may suspend accounts temporarily or permanently. Affected users receive a statement of reasons and may lodge a complaint via the contact page within six months; complaints are not decided solely by automated means.
- Single point of contact for users and authorities (Regulation (EU) 2022/2065, Digital Services Act): via the contact page, languages: German, Croatian, English.
§ 10 Liability
The Operator is not liable for users’ content, the accuracy of listings, the identity, solvency or reliability of users, or the conclusion and performance of transactions between users. The Operator is liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract; otherwise liability for slight negligence is excluded. The Operator is liable for interruptions to availability, e.g. due to maintenance or disruptions beyond its control, only within the scope of this provision.
§ 11 Term, termination and account deletion
The user agreement runs for an indefinite period. Users can end it at any time by deleting their listings and requesting deletion of their account via the contact page or by email; the account will then be deleted promptly unless statutory retention obligations apply. The Operator may terminate the agreement with 30 days’ notice – for dealers with booked services no earlier than the end of the paid term – and without notice for good cause, in particular in the event of serious or repeated breaches of these terms. Paid flat rates end when the booked term expires unless agreed otherwise.
§ 12 Changes to these terms
The Operator may amend these terms with effect for the future if this is necessary for legal, technical or economic reasons and users are not unreasonably disadvantaged. Registered users will be informed by email or in their account at least 15 days before the changes take effect. If a user does not object before they take effect, the changes are deemed accepted; the notice will point out this consequence. In the event of an objection, either party may terminate the agreement.
§ 13 Data protection
Information on the processing of personal data can be found in the privacy policy.
§ 14 Final provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence (e.g. Croatia).
- If the user is a merchant, a legal entity under public law or has no general place of jurisdiction in the EU, the place of jurisdiction for all disputes is the Operator’s registered location. Statutory places of jurisdiction apply to consumers.
- The Operator is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
- These terms are available in German, Croatian, English, Italian, Bosnian and Slovenian. In the event of discrepancies, the German version prevails unless mandatory law provides otherwise. Should individual provisions be invalid, the validity of the remaining provisions is not affected.
